Absolutely correct. IANAL either but I have 2 family members who are and
both have concurred regarding your above 3 points.

Not too shabby for a non-lawyer, Starwolf.

BTW - I have no opinion either way on the spectacle that's playing out in
this thread but got interested when I saw all the legal-eze starting to get
    thrown around.

Kinda hard to determine that.. sport .. Next question would be .. "what the
hell are you doing all this ranting about" ?

    If I
    You brought it up.. I didn't ..
    Why ?

    Not as a lawyer
Certainly ..not as a lawyer.. <grin> and that bemused bystander bit is
almost as ludicrous as the "I don't give a rat's ass" comment..

I felt someone should post some real data
I've sure benefitted from all that "real data" that you carefully researched
on usenet.. hmmm.. Usenet knowledge and advice is what got some of your
buddies bounced.. Many thanks .. for going to all that trouble, though.. The
unbiased and neutral viewpoint is always refreshing to read.. Especially the
    usenet lore that you posted..

    Clearly pearls before swine,
Thanks dude.. you sure make a powerful case.. but you are trying to argue
with the wrong guy.. The Dallas County Computer Fraud folks are the ones
that are checking out Andrew .. At least they are the ones who got in touch
with me.. Supernews, Internet America and some kind of Cox doin's are also
in the picture and I understand at least one of those accounts were
    cancelled, last night..

Notice.. I have been posting all day.. still here. I'm sure that if you
represent your usenet legal savvy to those people, you'd get better
results.. and maybe a little bit of respect.. I doubt it.. If not .. you
could always revert to your ordinary insulting self and try that.. Who
    knows...

LMAO... look around you Johnson.. no "entirety" of any newsgroups are
involved in anything of the kind.. As we speak.. there are quite a few
threads where some pretty good guys are talking and discussing all kinds of
stuff.. without you idiot flaming the shit out of them, if it suits you..
Ain't that strange ? All your posing has become too transparent to miss..
And look.. I've even been involved in some of those threads and exchanges..
no problems.. I was responded to civilly and sometimes it was hesitant and
grudgingly, but it was civil.. Fool...

What fraud did I perpetrate? It wasn't me who posted that binary. I
haven't even looked at it, since my news provider only does text.

You can get my email address out of my reply-to address (remove the
nospam stuff.) Have them drop me a line.

    another YAWN.

Take a good look.. loser.. It is going on .. right now, as we speak.. and
what tickles me, is the fact that these guys are not being flamed by you and
your little crew, if you don't like what is being posted.. It's almost over
when they recover and get back online, there is no doubt, your crew will be
trying to take back the newsgroup.. May not be so easy next time.. huh ?

Well, I certainly didn't come here to spread hate and discontent, that's for
    sure!

Heck, I have a feeling that even *you* occasionally find yourself appreciating
(if not actually outright liking) what I write....

Well said. How about we start a pool on how long this thread will
    last? Say $1.00 a play.

Best we be careful though or Bill will report us to the authorities
    for gambling.

There was nothing fraudulent in the binary posting. Nothing salacious, bogus,
falsified, altered, illegal, immoral, unkempt, disheveled, reworded, distorted,
rewritten, edited, masked, exaggerated, stricken, removed, added, adulterated,
decoded, recoded, encoded, or morse coded.

It was simply a copy of a public record from a public database of publically
available information made available to the public by the government entity
responsible for making such data public.

Anyone with an e-mail account and $3 can get the original data from the open
source site from which the binary posting came, compare the original, and
confirm that the above is true.

This isn't rocket science. I called my son, the rocket scientist, and asked
him. He told me that it most definitely was NOT.
