  4. While accepting your far greater experience and knowledge how can you be
    so certain that this is what would have happened? If the CPS were going
    to roll over why proceed with the prosecution in the first place?

    It seems farcical to me to waste the time and effort or is it simply a
    game to see who will dare challenge the charge and assuming most people
    don't then the criminal justice system just accrues more points and more
    cash? If this is the case then there is something seriously wrong IMO.

    Because in many cases the victims just accept it, like what happened
    here. In the event of a not-guilty plea, the CPS will look at the
    effort and possible gain from proceeding. In the event that they're
    putting their hands up to the lesser charge, it's not unlikely the CPS
    might have said, "sod it, there's no point in going for the WDC as
    well, it'd be too much hassle to proceed with."

    Can I just say that I told them this way up there ^^^. Obviously I *am* just
    a know nothing **** rather than someone who has wriggled out of some much
    much tighter corners (but I have been schooled by proper expensive experts).
    That JP broadly confirms the strategy is good because I'm assured by them
    wot know he's the definitive reference.
    I reckon that Adie and darcy are very gentle law abiding folk IRL though and
    didn't want to get into a scrap, which is a fair call if it suits them and
    they got off reasonably lightly as it transpired. Insurance may take a hit
    though.

    That is what I'm not too keen on with our justice system. There
    appears to be a penalty associated with (perfectly reasonably)
    defending your own corner. You seem to have to go in submissive
    and let them make their deliberations accordingly.
    Any attempt to defend yourself or to tell them your genuine
    feelings on the subject result in 'nastiness'. So much for a
    legal system based on truth and honesty.

    At least you're given the chance to argue it there though. In many
    countries traffic offences are almost always dealt with by the
    policeman on the spot, and I'm not sure if you have any right to
    appeal. I got done by frogplod a year or two back for speeding and
    dangerous driving (overtaking on a white line) and wasn't given any
    option but to pay up on the spot.

    Because the vast majority of people will do just what happened in this
    case. Its the whole reason behind plea bargaining.

    They would still have accepted it without a solicitor. To be fair
    though it was only a wdc charge rather than a dangerous driving one -
    which would have had far more dire consequences of you had pleaded
    guilty.
