    IME I would concur. CPS might choose not to bring the Due Care to court. If
    they do proceed a good Brief can cite the technical non illegality of
    undertaking and the lack of risk of doing so by bike. Make it known that you
    have an expert testimony or two to support the latter assertion. You may
    well find it subsequently goes away. The speeding you are stuck with but
    it's *only* a 3 pointer.

    Worth noting.
    Get a Brief who is known and experienced in the particular
    court/jurisdiction. They get useful inside whispers. Cost should be OK as
    it's shared.

    how much does a "brief" cost? As in, would it actually be
    significantly less than the fine for the careless?

    It's not the fine it's the *extra* 6 points, making 9 or 10 for the day. I
    don't think you want that!
    For a good solicitor (1) in a traffic case I paid £260ish to sort it out.
    For a QC in Scotland (Barrister in England I suppose) £800 for a
    consultation, preparation and half day for Court.
    Both were worth their weight in gold.

    (1) He was a bit of a Mate so I reckon he laid on a 25% discount.

    I got a CD-10 4 years ago and only got 4 points, so it's not necessarily 6
    especially seeing as he's being done for two offences in one go.

    I think mine cost me a little over a hundred quid, so well worth the
    money in my case. While I don't think he actually *did* very much, I
    think his very presence sent a message to the bench that I was taking
    it seriously.

    In your case, tho, it sounds that you want someone to actually argue
    not guilty, so you do need someone pretty good.

    Part of the problem is finding someone local to the court. I rang my
    personal solicitor, who gave me a few general numbers in Leeds (where
    I got done). I rang them, asking if they could recommend a firm that
    did road traffic work (and they all recommended the same firm), but it
    was a bit of a lottery.

    Arsebiscuits indeed. Still you could claim that you've see the error of
    your ways and your selling the blade and have got a nice sensible BMW
    instead.

    I got summoned for Due Care[1] and wound up with an SP30 and 4 points
    as the conviction after I admitted speeding.



    [1] Pulled by a Panda car with 2 janitors in. No way of measuring
    speed other than their opinion, so they went for due care.

    Wasn't trying to outrun them, was giving it beans down the Bristol
    Road in Birmingham and didn't spot them till they pulled up at traffic
    lights next to me and flagged me down.

    Learnt the lesson about observation after that.
