    Email from a mate of mine.

    His missus is ~8mths pregnant too.. same as my missus was when I got
    toasted.

    Birdman, hows things...

    Some dickhead decided my bike shouldn’t be on the road on Friday!

    I was riding down Burke road in East Ivanhoe, just cruising behind the
    traffic, when the traffic started to slow down.

    I slowed down also, and I was just coming to a halt a car length or
    two behind the car in front of me ….when….. BAM!!!

    The dick behind me didn’t notice the traffic slowing down, and slammed
    into the back of me, throwing my bike into the car in front of me, and
    flipping me off the bike!

    I bounced into the car in front, and bounced into the road a few
    times.

    The ambos came, and took me to the Austin hospital, they did a shit
    load of x-rays and CT scans, luckily I’m all clear. I spent the night
    in hospital, and they sent me home yesterday.

    Just some pretty bad bruising around my shoulders, back and neck – I
    came out of it pretty lucky. I’m glad I was wearing all of my
    protective shit.

    I’m fucking sore, but should be fine in a week or so.

    I haven’t see my bike yet – it was towed, but we spoke to the tow
    people. They said it’s fucked. A write-off for sure!

    So, it’s a sad day…….I’m fucking sore, and my great old GPZ is dead L

    Just cause some wanker was too busy SMSing his mate or changing a CD
    or some shit like that to look at the road for a few seconds!

    I don't see anything there along the lines of "post this up in that news
    group forum you're on so other people can read about what happened to me"...

    People who acknowledge that sort of thing as part and parcel of riding
    don't need stories about it relayed to them, and those who think they're
    invincible won't be swayed regardless of whether they read about 10 or
    10,000 accidents.

    In other words, what's the point of eroding your mate's privacy like that?

    I don't see anything there along the lines of "post this up in that news group forum you're on so other people can read about what happened to me"...
    Do you see anywhere that says dont?
    And then theres the people who dont acknowledge that sort of thing as
    part and parcel of riding, that need a swift reminder.
    Do you know who he is? Does anyone here? Do you know where he lives?
    So no, his privacy hasnt been dealt a killer blow has it? It would
    only be invading his privacy if I mentioned his full name or address,
    or some form of letting anyone know who he was, with no doubt.
    Not even a nice try.

    I remember going past that stack on Friday morning, the bike didtn't look
    too bad, it was up on the curb on its stand, but mind you, I didn't stop to
    have a good look. The back of the car he ran into was a mess though, he
    must have had a really good shove.

    yea kewl, he is sorta attached to the bike, its got a gazillion klms
    on it...

    Remember my GPX750 when I got wiped on that, didnt look bad but was a
    write off, could have got going again with new upper and screen, left
    side fairing and bellypan, and oil cooler!

    No, but if your mate wants to make a case of it, there's a little piece of
    legislation called "The Crimes Act 1900" which specifically says you're not
    allowed to do exactly what you've done - twice and it's "stalking".

    I suggest you read:

    Specifically Sect 35 2(h). Do this again, and you're guilty of a criminal
    offence for stalking too (correct me if I'm wrong Mad Biker).

    There's also an offence under the Crimes Act 1914, Sect 85ZD which says:
    "Wrongful delivery of communications:
    A person shall not intentionally cause a communication in the course of
    telecommunications carriage to be received by a person or carriage service
    other than the person or service to whom it is directed.
    Penalty: Imprisonment for 1 year."

    That's 1 offence right there, and doing it a second time earns you a double
    whammy for stalking - be careful with this stuff. Better hope he really is
    a mate, he sounds like he needs all the friends he can get at the moment :)

    It's your friends fault. If he had been riding defensively according to
    aus.motorcycles guidelines he would have been looking at the car behind him
    and gotten out of the way.

    hear he's still with us & up and about.

    BTW. How do you tow a bike without it falling over? I agree with Conehead,
    If it was towed, know wander it's a write off!

    Don't get too excited, James. I do hope you're not a lawyer.

    You might like to read the whole section. Especially the bit that says
    that such actions are to be interpreted as stalking if the intention is:
    "
    (a) to cause apprehension, or fear of harm, in the person
    stalked or someone else; or

    (b) to cause harm to the person stalked or someone else; or

    (c) to harass the person stalked. "

    If the law could be interpreted as loosely as you suggest, then (unless
    they are no longer talking to you) you'd be guilty of stalking your
    neighbours if you said hello to them twice.

    There is nothing in that that suggests it is illegal to copy content
    from an appropriately delivered message and include it in another.

    *Please* tell me you're not a lawyer.....
