Angle on speeding ticket - Advice please.

  1. He didn't say he believed or disbelieved the cop, Bada. He said that if
    you try that argument in court, you'll lose. That's what everyone else
    in here has been telling you too. Getting consistent and unanimous
    advice out of this mob is practically impossible, so ..... congratulations.

    not on the fine.. but in a court of law I will bet you my left
    testicle they could prove it without a shadow of a doubt, and thats
    all they have to do.

    put the GPS coordinates on a fine would just be a value added service
    to the finee, and the finers are not into value adding :)

    Well.. they _do_ have a photo of their location in every photo... call
    it proof or assertion.. choice is yours.

    G'day.

    If you must contest it, I think you are coming at it from the wrong
    angle.

    You state that the photo is "a piece of
    black paper with a red glow in the middle and a barely visible
    numberplate."

    Here in the West, the popo's can't use photo's that include any other
    vehicle in the shot. (The other vehicle may be the one that was
    speeding...)

    If the photo is black, then how can you (or they) ascertain that there
    is no other vehicle in the frame?

    ....Just my 2c worth.

    BTW: Glad to see that a lot of the old faces are still here after more

    Highly unlikely - thats a higher standard than murder and very hard to
    achieve

    Its not only *more* than they *have* to do, it's more than they
    *actually* do. For a fixed speed camera they just say "he was snapped
    doing X at Y location at Z time" They don't prove it, they just assert
    it. You then have to prove it wasn't you ( a bit different to the rest
    of our legal system) if you want to get off.

    In fact, IIRC it was Victoria that passed the law that said the camera
    is right even when it's wrong...

    <shrug> And as per the OP the photo can be a night time one with sod all
    surrounding landscape visible to identify the location.

    Thanks Dan,

    that is an angle I didn't think of.
    I don't know if the law in Qld is similar but a decent solicitor should be
    able to tell me.
    They government probably has it covered but that is the type of advice I was
    asking for.

    Why bother with a decent solicitor? Why not just launch straight
    in to court and display your ignorance of the law and of basic
    digital photography practices for reals, as it were.

    That said, you seem pretty determined to waste as much money as
    you possibly can on this thing, so yeah, go right ahead and get
    yourself an expensive solicitor. S/he'll charge you hundreds to
    say the same thing as *everyone* here has told you.
