Accidents in Petrol Stations for Legal Expertwitnessing in Spain

  1. We shall appreciate any data or reference about accidents in Petrol
    Stations. We are working in legal expert witnessing report for a
    Spanish Court of Law so any international approach is very welcome.
    Our researching priority is people run over (Knocked down) while
    walking in the petrol station.

    What is in question is your ability to see immediately that the UK courts
    will not treat this incident any differently to one of similar
    circumstances, but not in a filling station, such as a fast food restaurant
    car park.

  6. I am looking for more abilities. Accidents in Petrol Stations are very
    different each other, and every Court of Law treat them in a very
    different way, even in the same Spanish city. There are very few
    appeals so there is no jurisprudency, and accidentology has a lot to
    do in order to improve signals, lights, geometry or advices starting
    with a good phenomenology of well known dangers. For instance,
    children and very old people are in serious risk near trucks that can
    not see them below the cabin.

    petrol station, late at night, during a quiet spell..... her male colleague
    had told her he "only fires blanks, so it's OK, we don't need a french
    letter......."

  10. Do not worry. Fortunatelly, this is not a football match with
    hoolingans, but a survey for an Expert Witnessing report. I hope to
    find a way to compare accidents in Patrol Stations of different
    countries considering traffic, architecture an technical elements,
    signals and walkers behaviours.

    You aren't likely to obtain any useful help in usenet/newsgroups. The
    best you could expect would be to find one person who has had an injury
    in a petrol station.

    In English law, if someone is injured by a vehicle in a petrol station
    exactly the same principles would apply to an injury in a car park or on
    a highway. The driver of the vehicle would be criticised for failing
    to keep a proper lookout and would probably be held liable. If it could
    be shown that a pedestrian ran in front of the vehicle without looking,
    then the driver of the vehicle would either be held blameless, or there
    would be contributory negligence.

    If you want to know how many accidents have happened in petrol stations
    and in what circumstances, you can try asking
    a) the owners of petrol stations
    b) solicitors who represent claimants. You can do this by an
    advertisement in the Law Society's Gazette or perhaps by emailing APIL
    (Association of Personal Injury Lawyers) to ask if they are willing to
    ask their members for feedback.
    c) expert witnesses. There are none who specialise in petrol station
    accidents so you'd have to find out what professional journals they read.

    You're looking for situations to blame vehicle operators, instead of
    having pedestrians pay attention to where they are, such as idiot who
    will step behind a car that is reversing.

  15. Maybe, but this kind of messages can reach experts abroad, and some of
    them have published documents or references that I shall appreciate.
    In my experience, accidentes happend because:
    1. People
    2. Things (cars or any other mobile or non mobile)
    3. Places, like Petrol Stations. I focus my phenomenology here.
    I agree.
    Good idea.
    I am doing my best to become the first one. And my first step is to
    ask to anyone that can help me a little bit.

  18. No, I shall try to get the accident videos and written reports in any
    language in any country in order to learn how to investigate them
    better and what can be done improving the security in any petrol
    station. There are many videocamaras around, and one of my first
    approaches is to get videos. I looked for some in YouTube, but no one
    that I found is related with my research, at the moment.

    I have concerns about this. Someone who thinks that the best way to
    research the causes and legal consequences of accidents at petrol
    stations is to ask a bunch of random individuals on usenet about how to
    do it doesn't sound like an "Engineer, Forensic Investigator and IT
    Expert" as portrayed on the websites referenced below.
    I'd take you more seriously if your website didn't look like the sort of
    think cobbled up by the average nutcase.

    audiovisual forensic technologies and legal transcriptions to text.

    public prosecutors. However, I always starte my expert witnessing
    approach watching and listening to anybody interested in the topic, no
    matter what I already know about it.
