33bhp restriction question

    Maybe so, but they're not impounding them because they have too much of
    something (power in the case of a de-restricted bike) but because they
    *don't* have something. usually insurance. If someone goes to collect the
    offending vehicle with proof of insurance, and are happy to pay the recovery
    charges, Plod can't crush it.

    I can't see how Plod can crush a vehicle because it has more power than the
    rider has a license for.

    "Using a vehicle in a public place otherwise than in accordance with
    the licence held."

    If the rider's licence doesn't cover use of the vehicle, the rider;s
    insurance is invalid. Prime crushing turf, that is.

    The type of person who rides without insurance generally tends to have
    a piece of shit bike anyway - youngsters with scooters and slightly
    older kids with 20 year old POS GPZ500s and the like

    I've known literally hundreds of new riders whove technically been
    restricted to 33bhp but had full power bikes - I've never heard of a
    case where someone has been prosecuted for the offence. Same as I've
    never heard of anyone being prosecuted for breaking the speed limit
    where average speed cameras are installed anywhere outside of
    Northamptonshire.

    Tbh, I don't know what all the fuss is about, it's a law that no-one
    but the saddos takes the blindest bit of notice of

    tuned 125 nor, beofre that, a derestricted moped.

    What about, in the good old days, an LC350 with 250 sidepanels?
    There were stories about eagle-eyed plod spotting the extra disc.
    (Or a bigger Superdream for people with very low standards.)

    Never happened anywhere I've lived. As TOG said, no-one got nicked for
    tuned mopeds or 125s, and still don't. I derestricted every moped and
    125 I sold on the instructions of the new owner when I was at the shop.
    Quite often we'd restrict an ER-6 or Z750 and do all the paperwork -
    which is technically not needed by law - and then show the new owner
    how easy it was to remove one screw that made it full power again. They
    never came back for the first service with that screw in place.

    I was nicked for having a moped that couldn't be propelled by it's
    pedals and several of my mates were nicked for the same offence when
    we were riding around on so called sports mopeds. It used to be a
    favourite tug for Bedfordshire police in the mid '70s if they pulled
    you over for a spot check.

    The usual reply when told they were being twats was that because you
    couldn't pedal it you were riding a motorbike underage and could be
    done for riding without licence & insurance if they really wanted to
    be awkward. I can't remember the exact charge but it was effectively a
    construction & use offence rather than the licence one but telling a
    16 year old to accept the lesser charge or get done big style usually
    worked.

    Did you ever actually try to pedal one? I tried it once with my Fizzie,
    just to see. Damn near impossible.

    It was near enough impossible if everything worked properly so it was
    an easy nick for a **** of a cop.

    There's nothing to say that the rider is the owner though and the owner
    could happily show up at the nick and claim the bike by showing his proof of
    insurance.

    I don't think these cases are black and white.

    My Fizzie still had its pedal chain fitted cos I didn't see the point
    in removing it as no-one could see behind the casing anyway, and it was
    a pre 1977 model so wasn't restricted.
